These terms govern your use of Boardcall. By using the app, you agree to them. If you don't agree, please don't use the app.
Boardcall is made by Zach Weston, an individual developer in California. You can reach me at zachweston5@gmail.com.
Boardcall reads public wave, wind, and tide data and combines it with the boards you enter to produce a plain-English surf briefing and a board recommendation. Boardcall is not affiliated with, sponsored by, or endorsed by Surfline, NOAA, Open-Meteo, Anthropic, Apple, any surfboard brand or shaper named in the app, or any surf spot, break, or location referenced in the app. Brand and model names are used only to identify boards you may already own, and remain the trademarks of their respective owners.
Surfing is a hazardous activity that you choose to do. By using Boardcall you accept that you are solely responsible for deciding whether to enter the water and what to ride, and that you assume all risks of doing so — including risks that a Boardcall briefing described inaccurately, understated, or failed to mention at all. A "fire," "fun," "marginal," or "skip" verdict is an opinion generated from a model, not a statement that any given day is safe for you.
Briefings marked with a sparkle are written by Claude, an AI model provided by Anthropic. Boardcall sends that model the day's conditions at your break, your skill level and weight, and the boards it is choosing between; it does not send your name, email, or location. AI-written text can be wrong. Statements of fact in a briefing should not be relied on without checking them yourself, as they may be false, incomplete, misleading, or not reflect recent conditions. The board ranking itself is computed on your phone by a fixed set of rules; the AI writes the briefing and may explain a different choice from that ranked list.
You need to be at least 13 years old to use Boardcall. If you are under 18, you may only use it with the involvement of a parent or guardian who agrees to these terms on your behalf. Boardcall is not designed for and is not directed to children.
You're welcome to use the app for your own surfing. You're not licensed to copy, scrape, extract, resell, or redistribute its contents — the spot data, the local-knowledge notes, the board database, or the ranking rules — or to use them to build a competing product. The boards, spots, and profile you enter are yours; we claim no rights in them.
Some spots carry notes about crowding, access, parking, or local reputation. These describe what has been reported in surf media and public sources at the time they were written. They are not statements about any individual, they are not a judgment of anyone who surfs at a given break, and lineups change. Verify anything that matters locally, and follow posted rules and lifeguard instructions wherever you surf.
Boardcall is provided "as is" and "as available," without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that forecasts, board recommendations, or any other information in the app are accurate, complete, or current — they're built from third-party data and a set of general-purpose rules that can't account for every local condition, hazard, or your personal ability. We also don't guarantee the app will be available without interruption, and we may change, suspend, or discontinue any part of it — including third-party data sources — at any time.
To the fullest extent permitted by law, Boardcall and its developer are not liable for any injury, loss, or damage — direct, indirect, incidental, consequential, or otherwise — arising from your use of, or reliance on, the app or the information it provides. To the fullest extent permitted by law, total liability for any claim relating to Boardcall is limited to the greater of the amount you paid for it in the twelve months before the claim, or 100 US dollars.
Nothing in these terms limits liability that cannot be limited under the law that applies to you. In particular, and without limiting anything above, these terms do not exclude liability for fraud, for willful injury, or for any violation of law — California Civil Code section 1668 makes such exclusions unenforceable, and we are not attempting one. If you are a consumer, you keep every right you have under the mandatory consumer-protection law of the place you live, and nothing here is intended to take those rights away.
Boardcall offers an optional auto-renewing subscription ("Boardcall Pro") that removes the weekly limit on AI-written briefings. Everything else in the app — the full quiver, the map, and all spots — is free with no subscription required. Over the free weekly limit you still get a full briefing, written on your phone by Boardcall's own rules instead of by the AI.
You get Boardcall through the App Store, and Apple's own Licensed Application End User License Agreement governs your licence to use the app. These terms sit alongside it and describe how Boardcall itself works; where the two genuinely conflict on licence matters, Apple's agreement controls. Apple is not responsible for Boardcall or its contents.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the state and federal courts located in San Diego County, California are the intended venue for any dispute. If you are a consumer living somewhere else, this does not deprive you of the protection of the mandatory law of your own country or state, or of any right you have to bring proceedings where you live.
If any provision of these terms is held invalid or unenforceable, that provision is limited or removed to the minimum extent necessary, and the rest of these terms stay in full force. The failure to enforce a provision is not a waiver of it.
We may update these terms as the app changes. When we make a material change we'll update the date at the top of this page and ask you to review and accept the updated terms in the app. Continued use after that means you accept the revised terms. If you don't agree to a change, stop using the app — and you can cancel a subscription as described above.
These terms, together with the Privacy Policy and Apple's Licensed Application End User License Agreement, are the whole agreement between you and Boardcall's developer about the app, and replace any earlier version of these terms.
This document is a plain-language starting point drafted by the developer, not a substitute for review by a lawyer. If something here is unclear, contact us before relying on it for anything important.
